The County Assembly Service Board is established under the County Government Act 2012. The Board is a body corporate with perpetual succession and a common seal. It consists of –
The Speaker of the county assembly, as the chairperson;
A vice-chairperson elected by the Board from the members appointed under paragraph (c);
Two members of the county assembly nominated by the political parties represented in the county assembly according to their proportion of members in the county assembly; and
One man and one woman appointed by the county assembly from amongst persons who are experienced in public affairs, but are not members of the county assembly.
The County Assembly Clerk is the secretary to the County Assembly Service Board.
Mandate
The County Assembly Service Board draws its mandate from section 12 of the County Government Act, 2012 and section 11 and 12 of the County Assembly Services Act, 2017.
Functions
Direct and supervise the administration of the services and facilities provided by, and exercise budgetary control over, the Service;
Determine and review the terms and conditions of service of persons holding or acting in the offices of the Service;
Initiate, co-ordinate and harmonize policies and strategies relating to the development of the Service;
Initiate programmes –
for training and capacity building of members and staff of the county assembly and other persons;
that promote ideals of parliamentary democracy as set out in Article 127(6)(d) of the Constitution; and
that promote public awareness and participation in the activities of the county assembly; and
Do such other things as may be necessary for the well-being of the members and staff of the county assembly.
Powers
In addition to the powers of the Board under section 12(2) of the County Governments Act (No. 17 of 2012), the Board shall have the power to –
acquire, hold, charge and dispose of movable and immovable property;
sue and be sued;
despite the provision of any other written law, establish a pension scheme for officers of the Service and, from time to time, determine –
the rates of contribution to the scheme; and
the multiple of the annual basic salary for the group life and group personal accident benefits; and
do or perform all such other things or acts for the proper discharge of its functions under this Act and any written law, as may lawfully be done or performed by a body corporate.
Responsibility
In line with the County Government Act 2012 section 12(7), the County Assembly Service Board is responsible for –
Providing services and facilities to ensure the efficient and effective functioning of the county assembly;
Constituting offices in the county assembly service, and appointing and supervising office holders;
Preparing annual estimates of expenditure of the county assembly service and submitting them to the county assembly for approval, and exercising budgetary control over the service;
Undertaking, singly or jointly with other relevant organizations, programmes to promote the ideals of parliamentary democracy; and
Performing other functions necessary for the well-being of the members and staff of the county assembly; or prescribed by national legislation.
